Workers Compensation Responsibility

Several enquiries have been made to the Association as to workers compensation and who is responsible when there is a Labour Hire firm (LHA) involved.

Workers compensation premiums are calculated and paid to insurers by the employer as a percentage of total remuneration. In a Labour Hire scenario the employee is employed by the LHA not the Host employer. The LHA will be paying workers compensation based on remuneration of that employee. So the responsibility for the workers compensation claim is with the employer (LHA) not the Host Company.
